Germany and the US – investment and partnership ties between the two countries are deeply rooted. And with or without TTIP, one thing is certain: The US is Germany’s biggest trade partner.
To work in this area of cross-border law, Schultze & Braun has gathered a team of lawyers who are admitted to practise in the US and have wide personal networks there. Together with other colleagues, they have extensive personal experience of handling US-related matters such as the protection or realisation of assets in the US.
Over recent years, Schultze & Braun has commenced a number of Chapter 15 proceedings aimed at protecting German insolvency estates from US proceedings or the sale of assets in the US.

Advice to German companies
Schultze & Braun helps German companies to secure and enforce their legal and financial interests when US partners – shareholders, affiliates, suppliers or customers – enter insolvency. We also file claims in US insolvency proceedings on behalf of German companies.
Advice to German insolvency administrators
We help German insolvency administrators establish protection for assets, collateral or licences in the US, for example by commencing Chapter 15 proceedings in respect of insolvent German companies to shield their insolvency estate from attachment by creditors. We help insolvency administrators in Germany incorporate US financial interests into the German restructuring framework. We also advise clients looking to enforce liability or avoidance claims against persons located in the US or in accordance with US law.
